Terms of Service

1. Acceptance of Terms

By accessing or using Castings (“Service”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to any of these terms, please do not use the Service. We may revise these terms at any time; the current version is always published on this page, and your continued use of the Service after a change constitutes acceptance. If a change materially affects your rights, we will notify registered users by email or in the interface before it takes effect.

2. Description of Service

Castings is an online platform that connects casting directors and agencies (“Directors”) with talent (“Talents”).

1. 2.1Directors may publish casting calls, receive and review applications, and maintain a private talent database.
2. 2.2Talents may create profiles, apply to castings and manage their media portfolios.
3. 2.3We provide the technical platform only: we are not a party to the relationship between a Director and a Talent, we do not employ Talents, do not select participants, and do not guarantee that a casting will take place, that an application will be reviewed, or that any engagement or payment will follow.

3. Accounts & Registration

1. 3.1You must register with accurate information and keep your credentials confidential.
2. 3.2You are responsible for all activity under your account.
3. 3.3You must be at least 18 years old to register; a profile of a minor may only be created and managed by a parent or legal guardian, who is responsible for it.
4. 3.4Accounts must not be multiplied to circumvent the limits of a paid plan.
5. 3.5We may suspend or terminate accounts that violate these Terms.

4. User Obligations

You agree not to:

1. 4.1post false, misleading or fraudulent content, or impersonate another person, agency or brand;
2. 4.2upload material that infringes third-party intellectual property, image or privacy rights (see sections 5 and 6);
3. 4.3upload sexually explicit material, or any content involving minors that is not strictly professional in nature;
4. 4.4publish castings that require a payment from Talents in order to take part, or that serve to collect personal data for purposes other than casting;
5. 4.5use the Service for any unlawful purpose, or in breach of labour, advertising or data-protection law;
6. 4.6attempt to gain unauthorised access to other accounts, data or systems, or to interfere with the operation of the Service;
7. 4.7scrape, copy or harvest data or media from the Service without our prior written consent, including by automated means;
8. 4.8use contact details obtained through the Service for unsolicited advertising or for any purpose other than the casting they relate to;
9. 4.9resell the Service, sublicense it, or make it available to third parties outside your own agency without a written agreement with us.

5. Content Ownership & Licence

You retain ownership of the content you upload — photographs, video, audio, documents and texts (“User Content”).

1. 5.1We claim no ownership of it and do not sell it.
2. 5.2By uploading, you grant Castings a worldwide, non-exclusive, royalty-free licence to store, reproduce, resize, transcode and display your User Content solely in order to operate the Service: inside the platform, on the public page of the agency that published the casting, in notifications you subscribed to, and in exports (PDF, XLSX, ZIP) generated by you or by the agency the content belongs to.
3. 5.3We do not use User Content in advertising outside the Service without separate written permission.
4. 5.4The licence ends when you delete the content or your account, except for copies kept in backups for the period stated in the Privacy Policy and for copies lawfully downloaded, before deletion, by users who had access to them.

6. Photographs and Third-Party Rights

Media on the Service is often created by someone other than the person who uploads it. As a rule, copyright in a photograph or video belongs to its author — the photographer, or whoever acquired the rights from them by contract — while the person depicted holds rights in their own image and personal data. Uploading a file transfers no rights between users: an agency or Director who uploads a Talent’s photograph acquires no copyright and no image rights they did not already hold, and the Talent, the photographer and any other rightsholder keep theirs in full.

1. 6.1Whoever uploads content warrants that they hold, or have obtained in writing, every right required for that upload — from the author of the photograph or video, and from each person depicted (model release) — including the right to publish the material online, on an agency public page, and in exports produced by the platform.
2. 6.2A Director or agency that adds a Talent to its private database, or attaches media received by email, Telegram or a web form, does so on its own responsibility and remains answerable to the author and to the person depicted.
3. 6.3Authorship credits, watermarks and copyright notices must not be removed or obscured.
4. 6.4A Talent may withdraw consent to further publication of images of them by deleting them from their profile, by asking the agency that uploaded them, or by writing to us through the Help page.
5. 6.5We act as a hosting provider and do not verify rights in advance.
6. 6.6A rightsholder — a model, photographer, agency or other owner — may submit a complaint through the Help page, identifying the material, where it appears and the basis of the claim. We restrict access to material covered by a substantiated complaint within a reasonable time, normally five business days, and inform the user who uploaded it; that user may submit a counter-notice with evidence of their rights. Accounts of repeat infringers are terminated.
7. 6.7You indemnify us against any third-party claim, loss or expense arising from content you uploaded in breach of this section.

7. Billing, Payments & Refunds

Paid plans are subscriptions to the Service.

1. 7.1Prices are shown in the currency you select on the pricing page; by default it follows your interface language — hryvnia (UAH) for Ukrainian, US dollars (USD) for English and euro (EUR) for the other languages.
2. 7.2Payment is handled by the payment provider you choose at checkout; we never receive or store your card details.
3. 7.3A subscription with automatic renewal renews for the chosen period (monthly or annual) until you cancel it on the Billing page; cancelling stops future charges while the period already paid for runs to its end.
4. 7.4Where the chosen provider supports one-off payments only, the plan is extended by the period you paid for and no further charge is made automatically.
5. 7.5Refunds: you may request a full refund of any payment within 30 days of the date it was charged, for any reason and without explanation.
6. 7.6Send the request from the email address of your account through the form on our Help page; approved refunds are returned to the payment method used, normally within 10 banking days.
7. 7.7After that 30-day window a payment is non-refundable.
8. 7.8When a plan expires the account reverts to the Free tier automatically, and uploading new files may be blocked while stored data exceeds the limits of that tier.

8. Intellectual Property

The Service itself — its interface, design, logos, name, texts and software — is the exclusive property of Castings and is protected by applicable intellectual property law. You may not copy, modify, distribute, decompile or create derivative works of it without our prior written consent. This section does not affect your rights in your own User Content, which are governed by sections 5 and 6.

9. Disclaimer of Warranties

1. 9.1The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
2. 9.2We do not warrant that the Service will be uninterrupted or error-free, that messages sent through third-party channels (email, Telegram, payment providers) will always be delivered, or that a casting published by a Director is genuine.
3. 9.3You remain responsible for keeping your own copies of media that matters to you.

10. Limitation of Liability

1. 10.1To the maximum extent permitted by law, Castings shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of profit, revenue, data or opportunity, whether incurred directly or indirectly.
2. 10.2Our total cumulative liability for any claim relating to the Service shall not exceed the amount you actually paid for the Service during the one (1) month immediately preceding the event giving rise to the claim.
3. 10.3Where no payment was made in that month — including use on the Free tier — no compensation is payable.
4. 10.4Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Termination

1. 11.1You may delete your account at any time.
2. 11.2We may suspend or terminate your access for a breach of these Terms and will state the reason unless the law prevents us from doing so.
3. 11.3On termination your right to use the Service ceases immediately and your content is deleted as described in the Privacy Policy.
4. 11.4Sections 5, 6, 8, 9, 10 and 12 survive termination.

12. Governing Law

1. 12.1These Terms are governed by the law of Ukraine, without regard to its conflict-of-law provisions.
2. 12.2We ask you to raise any dispute through the Help page first; disputes that cannot be settled that way are submitted to the competent courts of Ukraine.
3. 12.3Consumers keep the protection of the mandatory rules of their country of residence.
